wen Terms of Service - Mobile App (iOS & Android)

Applies to: the wen mobile application for iOS and Android (the "App"). The web app and Telegram mini app are governed by the separate Web Terms at wen.live/legal/terms.

1. Agreement

The App is operated by AxonTech OÜ, an Estonian private limited company, registry code 17430331, registered address Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 5, 10145 ("wen", "we", "us"). These Terms are a binding agreement between you and wen (not between you and Apple Inc. or Google LLC) governing your use of the App. By installing or using the App you accept these Terms and the Mobile Privacy Policy. If you do not agree, do not install or use the App.

2. What wen is (and is not)

wen is a non-custodial software interface for crypto trading and related social features: a self-custodied wallet created at signup, balances read live from public blockchains and venues, spot trading, perpetual futures ("perps") executed on an independent third-party venue where available, copy trading, optional paid signal content ("cryptox") where available, rewards and referral programs, and social features. wen is not a custodian, bank, broker-dealer, investment adviser, portfolio manager, or fiduciary, does not hold or control your funds, and does not provide investment, legal, or tax advice. Nothing in the App is a recommendation to buy, sell, or hold any asset.

3. Regional availability and feature gating

The App is offered only in the countries shown on its App Store and Google Play listings, and the features available to you depend on your region. To comply with local law, sanctions, and store policies, we determine your approximate region (from IP address and device signals) and may enable, disable, limit, or modify individual features by region, including perps, copy trading, cryptox, randomized rewards (wheel, chests), leverage levels, and the referral program. Feature availability may change as laws and licenses change. You must not use VPNs, false information, or other means to misrepresent your location or access features not offered in your region; doing so is a material breach, may be unlawful, and is at your sole risk. Restrictions apply to features only; wen never controls your funds and cannot freeze them.

4. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher), able to form a binding contract, and not barred under applicable law. You may not use the App if located in, organized in, or resident of a comprehensively sanctioned jurisdiction, or if you are a sanctioned or restricted person. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.

5. Account and security

Provide accurate information and keep it current. You are responsible for activity under your account and for safeguarding your credentials, 2FA device, device passcode/biometrics, and any exported keys. wen will never ask for your password, 2FA codes, or exported keys. Report suspected compromise to support@wen.live. Losing your device does not lose your funds, but protect your account with 2FA and your device lock.

6. Non-custodial wallet and keys

Your wallet is created at signup and secured through Privy. wen does not hold, control, or have access to your private keys and cannot move or withdraw your funds. Optional key export is protected by your password and 2FA and is end-to-end encrypted on your device; after export you are solely responsible for key security. Blockchain transactions are irreversible; wen cannot reverse, cancel, or recover transfers, including to wrong addresses or unsupported networks.

7. Trading; market and protocol risks

You acknowledge and accept the risks of crypto trading, including: total loss of value; extreme volatility; leverage and liquidation of perps positions; funding costs; slippage; failed or delayed transactions; network congestion; smart-contract, oracle, and protocol vulnerabilities; MEV; venue downtime; token delisting or illiquidity; and stablecoin de-pegging. Displayed balances and prices are read from third-party chains and venues and may lag, contain errors, or briefly show as unavailable; unavailability of a reading does not mean loss of funds. You can lose money, including your entire balance. Never trade more than you can afford to lose.

8. Perps, copy trading, and cryptox

• Perps are routed to an independent venue with its own terms and geographic restrictions you must comply with; wen's agent key can place orders but cannot withdraw funds. Perps are high-risk leveraged instruments and are unavailable in regions where prohibited (§3).
• Copy trading mirrors a selected trader's trades at the size and limits you configure. Copied traders are not vetted, endorsed, or supervised by wen; past performance does not predict future results; losses are copied as well as gains; your results will differ from the copied trader's; you are solely responsible for selecting, monitoring, and stopping copying. If your trades are visible to copiers, you consent to wen displaying your positions and performance, and you owe no duty to copiers.
• cryptox provides general, impersonal signals distributed identically to all subscribers; it is not personalized advice, and no outcome is promised. Where the unlock is sold inside the iOS or Android app, the purchase is processed under the applicable store's payment terms; where offered outside the App, store payment terms do not apply. Access fees are non-refundable once access is delivered, except where store policies or mandatory consumer law provide otherwise.

9. XP, ranks, rewards, referrals

Rewards (XP, ranks, streaks, quests, wheel, chests, badges) adjust your experience inside wen, including fee discounts. They are not money, deposits, securities, or tokens, and are not a promise of any future token or distribution; they have no cash value, are non-transferable, may be modified or discontinued, may differ by region (§3), and may be revoked for abuse. Where randomized rewards are offered, disclosed odds apply. The referral program pays only on real fee-generating activity of referred users, may be modified or terminated prospectively, may be limited by region, and prohibits self-referrals, fake sign-ups, spam, and presenting wen as an income opportunity; abusive rewards may be withheld or clawed back.

10. Fees and taxes

Fees and discounts are shown at wen.live/fees and in-app at the time of each transaction; changes are prospective. You are solely responsible for all taxes arising from your activity.

11. User content and conduct

You retain ownership of content you post and grant wen a worldwide, non-exclusive, royalty-free license to host, display, and distribute it within the services. Prohibited content and conduct include: unlawful, infringing, deceptive, or manipulative content (including coordinated pumping and undisclosed paid promotion); harassment and hate; spam; sanctions or law violations; location misrepresentation (§3); market manipulation, fraud, or money laundering; attacking, scraping at scale, or reverse engineering the App (except as law permits); circumventing fees, limits, or security; and using another person's account. We may moderate content and restrict accounts. There is no tolerance for objectionable content or abusive users; objectionable content may be removed and offending users may be blocked or terminated.

12. App updates and changes

We may update the App (including automatically, per your device settings) and may add, change, or remove features, including for legal or store-policy reasons. Keeping the App updated is required for continued use. We may update these Terms prospectively; material changes will be notified in-app, and continued use after the effective date is acceptance.

13. Third-party services

The App interoperates with third parties we do not control, including blockchains, independent trading venues, Privy, data providers, and push-notification infrastructure (Apple, Google). Their availability, terms, and acts or omissions are outside wen's control, and wen is not responsible for them.

14. Apple App Store terms (iOS users)

These Terms are between you and wen only, not Apple. Apple is not responsible for the App or its content. wen, not Apple, is solely responsible for maintenance and support, warranty (to the extent not disclaimed), product claims, legal compliance (including consumer protection and similar legislation), and third-party IP claims relating to the App. In case of the App's failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the App's purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Your use of the App must comply with the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement usage rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Google Play terms (Android users)

Your download and use of the App from Google Play must comply with the Google Play Terms of Service. These Terms are between you and wen; Google is not responsible for the App and provides no warranty or support for it.

16. License and intellectual property

We grant you a limited, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, for its intended purpose, subject to these Terms and applicable store usage rules. The App, the wen name, logo, design, and software are owned by wen or its licensors; no other rights are granted. You may not copy, modify, distribute, sell, or lease any part of the App, or reverse engineer it except as permitted by law.

17. Termination

You may stop using the App and close your account at any time; because wen is non-custodial, you can withdraw your funds at any time before closure, and deleting the App does not delete your account. We may suspend or terminate access for breach, legal requirement, sanctions, or risk to users or the platform; termination does not affect your control of your wallet or funds. Sections that by nature survive termination (including §§6–10, 13–21) survive.

18. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW. wen DOES NOT WARRANT THAT PRICES, BALANCES, SIGNALS, LEADERBOARDS, OR OTHER DATA ARE ACCURATE, COMPLETE, OR TIMELY.

19. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: wen AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL; AND wen'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO wen IN THE 12 MONTHS PRECEDING THE CLAIM AND (B) €100. NOTHING IN THESE TERMS LIMITS LIABILITY FOR INTENT OR GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND NOTHING AFFECTS MANDATORY CONSUMER RIGHTS IN YOUR COUNTRY OF RESIDENCE.

20. Indemnification

You will indemnify and hold wen harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, violation of law, your content, or misuse of the App, except to the extent caused by wen's own breach or misconduct and to the extent permitted by applicable consumer law.

21. Governing law and disputes

These Terms are governed by the laws of Estonia. Disputes shall be resolved by the courts of Harju County, Estonia, except that consumers in the EU/EEA may bring proceedings in their country of residence and retain all mandatory local protections. EU consumers may also use the European Commission's Online Dispute Resolution platform. Before formal proceedings, contact support@wen.live.

22. General

If any provision is unenforceable, the remainder stays in effect. No waiver by non-enforcement. You may not assign these Terms; we may assign them in a corporate transaction.
